Terms of service

TERMS OF SERVICE

These Terms of Service apply when you use inku.uk or purchase products from INKU. INKU is operated by SEASTREAM INTERNATIONAL TRADE CO., LIMITED, trading as INKU (“INKU”, “we”, “us” or “our”). Our online store is powered by Shopify.

By using our website or placing an order, you agree to these Terms, together with our Privacy Policy, Refund Policy and Shipping Policy. Nothing in these Terms limits any rights or remedies that cannot lawfully be excluded under applicable consumer law.

1. ELIGIBILITY AND ACCOUNT INFORMATION

You must be legally capable of entering into a contract to place an order. You are responsible for providing complete and accurate account, billing, payment and delivery information and for keeping any account credentials secure.

2. PRODUCTS

We make reasonable efforts to describe and display our products accurately. Colours and appearance may vary slightly depending on your device, screen settings and normal production variation. Product images are for illustration and may not perfectly represent colour or scale.

Temporary tattoo products are for external cosmetic use only. Please follow the application and skin guidance shown on the product page. Avoid use on irritated or broken skin and discontinue use if irritation occurs. Patch testing is recommended, particularly for sensitive skin.

3. ORDERS AND CONTRACT FORMATION

When you place an order, you are making an offer to buy the products in your basket. An order is accepted when we send confirmation that it has been accepted or dispatched. We may refuse or cancel an order where reasonably necessary, including where a product is unavailable, payment cannot be authorised, pricing or product information contains an obvious error, or we reasonably suspect fraud or misuse.

If we cancel an order after payment has been taken, we will refund the amount paid for the cancelled item or order.

4. PRICES, VAT AND PAYMENT

Prices are shown in GBP unless otherwise stated. Prices shown on our store include applicable taxes where required. Delivery charges and any other charges payable by you will be shown before you complete checkout.

For goods dispatched from outside the United Kingdom, customs duties, import VAT, handling fees or other import charges may apply in some circumstances. Please see our Shipping Policy for further information.

You must use a payment method that you are authorised to use. Payment processing may be provided by Shopify Payments, PayPal or other payment providers made available at checkout.

5. SHIPPING AND DELIVERY

Orders are dispatched from our fulfilment location in China. Delivery estimates are not guaranteed and may be affected by customs, carriers, public holidays, weather, peak periods or other events outside our reasonable control.

Risk of loss or damage to goods remains with us until the goods are delivered to you or to a person you have identified to receive them, except where applicable law provides otherwise.

Full delivery information is set out in our Shipping Policy.

6. CANCELLATIONS, RETURNS AND REFUNDS

Your rights to cancel, return products and receive refunds are described in our Refund Policy. These rights are in addition to any statutory rights you may have where goods are faulty, damaged or not as described.

7. INTELLECTUAL PROPERTY

The INKU name, branding, website design, product artwork, graphics, photographs, text and other original content on this website are owned by us or used with permission and are protected by applicable intellectual property laws.

You may use the website for personal, non-commercial shopping purposes only.

You must not copy, reproduce, distribute, modify, republish, commercially exploit or create derivative works from our protected content without prior written permission, except where permitted by law.

8. THIRD-PARTY SERVICES AND LINKS

Our website may use or link to third-party services, including Shopify and payment, analytics, shipping and social-media providers.

We are not responsible for the content or independent practices of third-party websites. Your use of third-party services may also be subject to their own terms and privacy notices.

9. PRIVACY

Our collection and use of personal information is described in our Privacy Policy.

Shopify also processes information in connection with providing the ecommerce platform used by our store.

10. ACCEPTABLE USE

You must not misuse the website, attempt unauthorised access, introduce malicious code, interfere with the operation or security of the website, use the website for unlawful purposes, infringe another person’s rights, or use automated tools in a way that materially disrupts the service or violates applicable law.

11. ERRORS AND AVAILABILITY

We may correct typographical errors, inaccurate product information or pricing mistakes and update availability information.

If an error materially affects an order you have already placed, we will contact you and, where appropriate, give you the option to confirm the corrected order or receive a refund.

12. LIABILITY

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability that cannot be excluded under applicable consumer law.

Subject to the paragraph above, we are not responsible for losses that were not reasonably foreseeable when the contract was formed, or for business losses arising from a purchase made wholly or mainly for personal use.

We are not responsible for delays or failures caused by events outside our reasonable control, although this does not affect any statutory rights you may have.

13. CHANGES TO THESE TERMS

We may update these Terms from time to time.

The version published on this page at the time you place an order will normally apply to that order, except where a change is required by law.

14. GOVERNING LAW

For customers in the United Kingdom, these Terms are governed by the laws of England and Wales, except to the extent that mandatory consumer protections in your place of residence apply.

If you live in Scotland or Northern Ireland, you may also have the right to bring proceedings in your local courts.
